Processing in the U.S.

Some of your personal information is processed by us in the USA. By using our services, purchasing our products, and providing your personal information to us via the website or directly, you expressly acknowledge and agree to the transfer of some of your personal information to the USA, which may have a lower standard of data privacy laws than in your country of residence. Our security measures are described below in this Privacy Notice.

Additional Information about Sharing Your Personal Information with Third Parties

We do not allow any third parties to have access to your personal information, except as required or permitted by applicable laws, or in accordance with this Privacy Notice. We may disclose your personal information to our subcontractors, agents, or payment service providers (who may be located in the USA or other countries that do not have stringent data privacy laws equivalent to the standards of the GDPR) with whom we contract to assist us in providing the products or services. We require such subcontractors or agents to agree in writing to comply with the privacy and security standards described in this Privacy Notice. We have safeguards in place to protect your personal information that are agreed to by our business partners.

There may be instances when we disclose your personal information to other recipients:

  • to verify or enforce compliance with the policies governing the services;

We may share your personal information with other entities in connection with the sale, assignment, merger, or other transfer of all or a portion of the Group’s business to that other entity.

In any instance where we need to share your personal information with third parties, such as legal or financial advisors, including auditors, distributors, vendors, suppliers, and other third parties, we will restrict the nature and categories of personal information to that which is required to comply with our contractual obligations to you, or our legal and/or regulatory requirements. We may de-identify your personal information to protect your privacy, where appropriate to do so.

How We Protect Your Personal Information 

The Group understands that storing data in a secure manner is essential. The Group stores personal information and other data using reasonable physical, technical, and administrative safeguards to secure data against foreseeable risks, such as unauthorized use, access, disclosure, destruction, or modification. Although we make good-faith efforts to store the information we collect in a secure operating environment that is not available to the public, we cannot guarantee complete security. Further, while we work to ensure the integrity and security of our network and systems, we cannot guarantee that our security measures will prevent third-party “hackers” from illegally obtaining this information.

How Long We Keep It

We will store your Personal Data (i) as long as is necessary to process your Personal Data for the purposes mentioned above, and as long as the legal basis applies, (ii) as long as you make use of our services and have not deleted your account, and a legal basis and purpose applies for the processing, or (iii) as long as we are legally obliged to store your Personal Data.

European Data Privacy Information

The Group companies are the data controllers under the Data Privacy Laws. This European Data Privacy Information section applies to residents in the European Economic Area, Switzerland, and the UK who purchase our products and/or use our services, or who otherwise are resident in these territories, and whose personal information is used by the Group for commercial purposes, and also to other customers or prospective customers of our European affiliates.

Under the GDPR, you have certain rights to make requests regarding your Personal Data, which are all subject to the exemptions and qualification under the Data Privacy Laws. You have the right to ensure your personal information is accurate; we request that you let us know if your personal information changes. You have the right to request that we delete your personal information (although we may still need to retain your personal information as described above in this Privacy Notice for contractual and/or legal purposes). You have the right to request that we restrict the processing of your personal information (although we will still need to process your personal data during the duration of the contract and beyond for legal purposes). However, in certain circumstances where we rely on legitimate interests, we may still be able to process your Personal Data, if we have compelling grounds to do so. Haas transfers your Personal Data within the Group, and/or to other third parties, such as our third-party service providers outside of the EEA/UK. When we do so, we transfer the information in compliance with applicable data protection laws. In particular, we have implemented safeguards in the form of standard contractual clauses as adopted and amended by the implementing decision of the European Commission 2021/914.

California Data Privacy Information

If you are a resident of the State of California, you have certain rights under California law.

California law permits California residents to request from a business with whom the California resident has an established business relationship, certain information about the types of personal data the business has shared with third parties for those third parties’ direct marketing purposes, and the names and addresses of the third parties with whom the business has shared such information during the immediately preceding calendar year.

These guidelines are for other parties authorized by Blue Inc USA through a separate agreement wishing to use Blue Inc USA‘s trademarks, service marks, trade names, trade dress, images and/or logos (collectively referred to herein as "Trademarks") in promotional, advertising, point of sale, instructional or reference materials, on a website or in any other materials. All use of the Trademarks shall be governed by agreements entered into between Blue Inc USA and the user herein ("You") along with these Guidelines.

Authorized Use of Blue Inc USATrademarks


Usage

The Trademarks may only be used to identify Blue Inc USA products and services. Use of the Trademarks should be as an adjective, and not a noun. For instance, "buy a Blue Inc USA cabinetry," not "buy a Blue Inc USA." Do not pluralize the Trademarks or make them possessive. Do not abbreviate any Trademark, or join it with other words, symbols, numbers, or trademarks that do not belong to Blue Inc USA. Always ensure proper spelling of the Trademarks and designate the Trademarks with an ® symbol if appropriate and in accordance with these Guidelines. The Trademarks should be differentiated from other words when in print, whether the Trademarks appear in print, on a website, in a video advertisement, on packaging, or in other advertising. You may differentiate the Trademarks from the surrounding words by using a proper trademark notice symbol (discussed below). You may also differentiate the Trademarks by, for example, placing the Trademarks in either stylized or capital letters, putting the Trademarks in quotation marks, or using boldface or italic type.


Advertising, Promotional, Point of Sale, Sales Materials and Website Use

Only Blue Inc USA or other authorized parties may use the Trademarks in advertising, promotional, point of sale, sales materials and websites. Blue Inc USA and authorized third parties may use the Trademarks only as provided for in accordance with any agreements between Blue Inc USA and You, and all use of the Trademarks shall be in accordance with these Guidelines. All use of the Trademarks must always be in conjunction with the appropriate terms that define the relationship authorized by Your contract with Blue Inc USA.


Publications

You may use a Blue Inc USA word mark in connection with magazines, periodicals or advertising provided You comply with the following requirements:

  • The use reflects favorably on both Blue Inc USA and its products
  • A trademark attribution notice is included in the credit section giving notice of Blue Advanced Machinery’s ownership of its Trademarks. For example: Blue Inc USA is a registered trademark owned and licensed by Blue Inc USA.
  • Your name and logo appear more prominent than the Trademarks on all printed materials related to the publication.
  • No Trademarks appears in the publication or on any materials related to the publication without express written permission from Blue Inc USA.
  • A disclaimer of sponsorship, affiliation or endorsement by Blue Inc USA, similar to the following, is included in the publication and all other related print materials: [Title] is an independent publication and has not been authorized, sponsored, or otherwise approved by Blue Inc USA.


Unauthorized Use of Blue Inc USA Trademarks


Company, Product or Service Name

You may not use or register, in whole or in part, any Trademarks as part of a company name, trade name, product name, service name, or as a domain name.


Blue Inc USA Trademarks, Logos and Graphic Symbols

You may not use the Trademarks (including any logos or other graphic symbols, icons or alterations thereof, which are owned by Blue Inc USA) on or in connection with websites, products, packaging, manuals, promotional/advertising materials, or for any other purpose except pursuant to an express written trademark license from Blue Inc USA agreement, license agreement, or other agreement which references the same.


Variations, Takeoffs or Abbreviations

You may not use a variation of the Trademarks (including any logos or other graphic symbols, icons or alterations thereof, which are owned by Blue Inc USA) for any purpose. You may not use a variation, phonetic equivalent, phonetic similar, foreign language equivalent, takeoff, or abbreviation of Blue Inc USA’s Trademarks for any purpose. For example, " Blue Inc USA 4Sale" or " Blue Inc USA Reel" is not acceptable.


Domain Names

You may not use an identical or virtually identical Blue Inc USA Trademark in any domain name. For example, "https://blueincusawood.com/" or "https://blueincusa4sale.com/" is not acceptable.


Blue Inc USA’s Trade Dress

You may not use an image of a Blue Inc USA product, and You may not imitate the distinctive Blue Inc USA trade dress (e.g. the appearance of its products), web site design, logos or typefaces. You may not use Blue Inc USA’s trade dress or imitate it for Your website.


Slogans and Taglines

You may not use or imitate any Blue Inc USA slogan or tagline.


Merchandise Items

You may not manufacture, sell or give away merchandise items, such as T-shirts, mugs, etc. bearing any Trademarks, including graphic symbols, logos or icons, except with the prior written consent of Blue Inc USA.


Endorsement or Sponsorship

You may not use any Trademarks, including but not limited to, any graphic symbols, logos, icons, trade dress, etc. in a manner that would imply Blue Inc USA’s affiliation with or endorsement of, sponsorship, or support of a third-party product or service.


Disparaging Manner

You may not use the Trademarks in a disparaging manner.


PROPER TRADEMARK ATTRIBUTION STATEMENT

Distribution Within Specific Areas

  1. All use of the Trademarks shall be limited to the Territory, as defined in the Dealer Agreement between You and Blue Inc USA. For all products, product documentation, or other product communications that will be distributed in Your Territory, You must use the appropriate trademark symbol (TM, SM, ®) the first time the Trademarks appear in the text of the advertisement, brochure, or other material.
  2. Include an attribution of Blue Inc USA’s ownership of the Trademarks either in small print at the end of the specific communication or within the credit notice section of Your communication or documentation. For example: Blue Inc USA marks are registered trademarks owned and licensed by Blue Inc USA.
